FTC Takes Action Against Payment Processor Humboldt Merchant Services for Knowingly Facilitating Payment Processing for Sham Merchants
The Federal Trade Commission has taken action against payment processor Humboldt Merchant Services, alleging it knowingly facilitated payment processing for more than 1,000 sham merchants engaged in fraud, including shell companies used for unauthorized billing scams. Under a proposed order, Humboldt will pay $12 million for consumer redress and be permanently banned from processing payments for high-risk merchant categories including straw companies, merchants on fraud watchlists, and certain e-commerce entities.
Why it matters: The proposed order, filed in U.S. District Court for the Eastern District of Michigan, will become legally binding if approved and signed by a judge, directly restricting Humboldt's business operations and requiring substantial payment to affected consumers.

Sandbox Mutual Insurance CO. v. CE Design, Ltd.
Sandbox Mutual Insurance Company sought a declaration in Cook County circuit court regarding which of two competing judgments has priority: one entered in its favor in Saskatchewan, Canada, and another entered against it in Lake County, Illinois. The Cook County court dismissed the complaint for lack of subject-matter jurisdiction, finding the controversy not yet ripe for decision, and Sandbox Mutual appealed.
Why it matters: This appeal addresses whether an Illinois court has jurisdiction to declare priority between competing judgments issued in different jurisdictions over the same insurance policy dispute.

Natural Resources Defense Council Inc v. New Jersey Department of Environmental Protection
The Court of Appeals for the Third Circuit granted petitions by environmental organizations challenging a Water Quality Certification issued by the New Jersey Department of Environmental Protection to Transcontinental Gas Pipe Line Company for its proposed Northeast Supply Enhancement Project. The court vacated the certification and remanded for further proceedings, finding that NJDEP arbitrarily reversed its earlier 2019 denial, certified the project before resolving essential monitoring requirements, failed to explain compliance with water quality standards, and denied adequate public comment opportunity.
Why it matters: The decision returns the state certification process to NJDEP, blocking the pipeline project's advance pending compliance with Clean Water Act section 401 requirements and state water quality standards for the Raritan Bay segment.

BMO Bank N.A. v. Wilson
The Ohio Court of Appeals affirmed a trial court's grant of summary judgment in favor of BMO Bank N.A. against a defendant who financed a boat through a loan agreement executed in April 2022, made only 17 of 180 required payments, and then denied the debt's existence. The appellate court rejected the defendant's four assignments of error, finding them unsupported by legal argument, citation to authority, or reference to the record, as required by appellate rules.
Why it matters: The decision upholds BMO Bank's right to recover the boat and trailer and the remaining loan balance from the defendant; it also establishes that pro se litigants must meet the same procedural standards as represented parties in appellate briefs.
